Dr. Winkenwerder was one of the first to call for electronic health records for all Americans…even before the emergence of the Internet. Years later, while serving at the US Department of Defense, he led the implementation of the largest electronic health record system in the world. He worked with The White House and the Secretary of Health and Human Services, to accelerate government efforts toward the adoption of health IT.
The HITECH Act of 2009 passed by Congress provided more than $25 billion to promote the adoption of electronic records and health IT solutions that generate “meaningful use” of information to improve quality and reduce medical costs. Today, most physicians utilize electronic records. Yet, many systems are not interconnected, consumers still have limited control over their own personal health information, medical prices and quality information is not transparent, and proof of cost savings from health IT is lacking. In March 2010, President Obama signed into law the Affordable Care Act (ACA), following a protracted and partisan debate. The objective of the new law was to extend health care coverage to tens of millions of Americans, reducing the ranks of the uninsured, while making health care coverage less costly overall and more affordable for families and individuals. During the ensuing years various elements of the law went into effect, some popular and others less so. Opponents challenged the law’s constitutionality before the US Supreme Court. The Court responded with a “nuanced” ruling that held up key parts of the law, while striking down the forced expansion of Medicaid by states and labeling the “individual mandate” as a permissible tax-like penalty. In late 2014, The Obama Administration sought to begin enrolling newly eligible individual participants through the now famously flawed healthcare.gov website. Significant problems emerged. Many of the technical issues were ultimately fixed. More than 7 million Americans were enrolled in 2014 into new federally subsidized coverage plans through state-based insurance exchanges. The legal mandate for medium-sized employers was postponed for two years until 2016, and postponed for larger employers until 2015 with a modified type of mandate.
The public and political debate about this law has continued. Polls generally show a majority of Americans still in opposition to this legislation, and the legal process utilized to enact it. The issue of “Obamacare,” as it has been dubbed by many, is expected to be an important one for the 2014 and 2016 national and state elections. Most Americans and most businesses are directly affected by this legislation.
